Welcome to Practical Trainer Interactive, Inc. (along with our affiliates, referred to as "Practical Trainer," "State School LLC," "we," or "us"). This Privacy Policy is designed to help you understand how we collect, use, and share information to operate, improve, develop, and safeguard our services, as described in this Policy. It outlines how we collect and process your personal information when you visit Practical Trainer websites, use any Practical Trainer services, including the Practical Trainer app (the "App"), or engage with us through support services such as live chats, email communications, social media, and other online or offline services we provide (collectively referred to as the "Services"). This Privacy Policy applies to all our Services unless otherwise specified.

1. WHAT PERSONAL INFORMATION WE COLLECT

Depending on how you interact with Practical Trainer and our Services, we may collect your personal information. The sources from which we collect this personal information fall into three categories:

  • Information we collect automatically

  • Information we collect from other sources

1.1. Information You Provide

You may provide personal information when using our Services, completing registration, viewing content, contacting us, responding to surveys, or making purchases. Examples include:

  • Standard Identifying Information: Name, mailing/billing address, email, date of birth, and phone number. If provided, your name will be public, and your phone number may help connect you with other members.

  • Purchase Information: Details related to orders and delivery. Payment info is collected by our payment partners.

  • Profile Information: Username, weight, height, gender, photo, and location (if added) will be public.

  • Contact Information: If you sync your contacts, we will store names, emails, and phone numbers to help grow your network.

  • Geolocation Data: If enabled, we collect location-based data, such as your IP address and proximity to Bluetooth networks or beacons.

  • Physical Characteristics: Movement data is collected for improving exercise form but is not used for identification.

  • Your Image or Likeness: Collected through app features, equipment cameras, and user profiles. Used only when activated by you.

  • Your Voice: Voice commands may be used to enhance services but not for identification.

  • Workout Characteristics: Height, weight, heart rate, and performance metrics.

  • User Generated Content: Photos, hashtags, or videos you share via the platform.

  • Connected Devices/Accounts: Data from connected devices (e.g., fitness trackers) or accounts (e.g., music streaming).

  • Feedback and Support Communications: Records of customer support interactions, including emails, chats, and social media.

  • Surveys and Reviews: Information provided in surveys or testimonials.

  • Promotions and Competitions: Data submitted for promotions, sweepstakes, or competitions.

  • Sensitive Personal Information: Processed only with consent and as needed for providing services, where legally required.

  • Other Information: Any additional data shared during visits to studios or retail locations.

1.2. Information We Collect Automatically

  • Contact Information: If you sync your Contacts via your mobile device, we will continue to sync them periodically until you disable “Contacts syncing” in the Privacy section of your device’s Preferences. Disabling this will stop syncing and remove your Contacts information from our system.

  • Information Generated Through Service Use: This includes data such as registered and attended classes, members you follow and those following you, followed hashtags, and workout performance details like leaderboard rank, workout output, speed, distance, calories burned, and accuracy metrics. If you connect a heart rate monitor, your heart rate during workouts will also be collected.

  • Fitness Data: We collect fitness-related information such as in-app scores, calories burned, workout duration, and heart rate (if connected). While we do not collect medical information, some workouts, like pregnancy or mood-based exercises, may be considered health-related under certain privacy laws and will be visible in your profile.

  • Inferences: We may collect data to make inferences, but these are only used to recommend workouts or classes you might enjoy.

  • Information from Your Device: This includes device data such as IP address, device identifiers, mobile carrier, browser type and language, operating system, and location (if enabled).

  • Usage Data: We collect information about how your device interacts with our Services, such as accessed content, pages visited, and time spent on the Services. This data helps us improve our offerings through usage analytics.

  • Internet or Other Network Activity: Information such as browsing history and interactions with our websites, apps, and marketing materials may be collected.

  • Location Information: If enabled, we may collect location data such as IP address, GPS location, and proximity to Bluetooth networks. You can opt in or out of location sharing, but disabling it may affect location-based services like run tracking. Some of this information may be gathered using Cookies and similar technologies.

1.3. Information We Collect from Other Sources

  • Other Applications: If you access our Services through third-party applications like the Apple App Store, Google Play, or Social Networking Sites (SNS) such as Instagram, Twitter, or Facebook, we may collect information from those apps based on your privacy settings. This can include your name, SNS user ID, App Store username, location, gender, birthdate, email, profile picture, and SNS contacts.

  • Security: To protect your information and our Services, we may collect data such as your device’s IP address, location, and other identifiers through third-party applications to ensure account safety and security.

  • To send marketing and promotions: We may contact you via phone, email, mail, push notifications, or SMS with information about offers, promotions, events, or services you might be interested in. Personalized marketing communications are based on your usage data. You can opt out of marketing at any time.

  • For analytics, research, and product improvement: We use data to understand how our products and services are used, monitor performance, and conduct research to improve our offerings. Some data may be anonymized and shared in aggregate form.

  • For quality assurance and training: We monitor communications and interactions to ensure the quality of support and improve training. We provide notice and obtain consent for monitoring as required by law.

  • To ensure security and integrity: We use data to detect and prevent fraud, spam, and illegal activity, as well as to monitor CCTV for safety on our premises.

  • For hiring purposes: We use your data in connection with employment applications and hiring processes.

  • To comply with legal requirements: We may use your data to comply with laws, respond to legal requests, and resolve disputes related to our Services. This includes using your IP address to comply with global privacy regulations.

  • For safeguarding and asserting rights: We may use your data to defend our vital interests, assert claims, or for any other lawful business purpose related to the above or disclosed when collecting your personal information.

3. WHO WE SHARE YOUR PERSONAL INFORMATION WITH

  • Group Companies: We may share your personal information with other companies within the Practical Trainer group for purposes consistent with this Privacy Policy.

  • Service Providers: We may share your personal information with third-party service providers (e.g., IT, analytics, payment processing, cloud storage, technical support) and business partners (e.g., marketing, research, consultants) to process data as described in this Policy. Aggregated, anonymous data may also be shared for analytics purposes. Practical Trainer ensures that data protection agreements are in place before sharing data with partners.

  • Third-Party Apps: If you connect your Practical Trainer account to third-party applications (e.g., Apple, Meta, Spotify), we may share information such as workout data or profile details. The privacy policies of these third-party apps govern how your data is processed. If connected, other Practical Trainer members on the same app may also see that you are a member.

  • Other Users of Our Services: Depending on your profile settings, certain personal information may be visible to other Practical Trainer members. Profiles are public by default, and members can search for others by username and name. Photos uploaded as profile pictures will remain visible even if your profile is set to private, but other details will not be accessible.

  • Law Enforcement, Regulators, Government Agencies, or Courts: We may share your personal information, including CCTV images, with law enforcement, regulators, insurers, legal advisors, government agencies, or courts if necessary to comply with the law, defend our legal rights, protect your rights or interests, or address security, fraud, or technical issues.

  • Potential Buyers: In the event of a potential or actual purchase, merger, acquisition, reorganization, or similar transaction, we may share your personal information with buyers or their advisors. We ensure the buyer or transferee uses your data only for the purposes outlined in this Privacy Policy.

4. COOKIES, ANALYTICS, AND SIMILAR TRACKING TECHNOLOGIES

We use cookies and similar tracking technologies like pixel tags, web beacons, and social media widgets (collectively "Cookies") to collect and use personal information for purposes such as analytics and interest-based advertising. For instance, cookies help track items in your shopping cart, including abandoned carts, to trigger reminder messages via SMS.

We may also use device identifiers, web storage, third-party analytics services, and session replay tools to gather information about your interactions with our content and Services. Session replay services allow us to capture and analyze your activities, such as movements, scrolling, clicks, and visit duration, to fix technical issues and improve our Services. Some analytics can be managed or removed via our privacy cookie settings.

5. FITNESS DATA

"Fitness Data" refers to any information related to your fitness performance and workouts, such as calories burned, workout duration, and heart rate if you connect a heart monitor and provide consent. We do not use Fitness Data for identification purposes.

Why do we process your information?

  • Analyze your performance: We use Fitness Data to track and compare your past and current performance, offering insights and analytics about your progress over time.

  • Provide workout recommendations: Based on inferences about your preferences and practices, we may recommend workouts, such as exercises targeting specific muscle groups, based on your previous activities. These recommendations are derived from the Fitness Data we collect.

Practical Trainer may also share Fitness Data with trusted third parties for monetization or partnership purposes, ensuring it is handled securely.

6. INTERNATIONAL DATA TRANSFERS

Practical Trainer is a US-based company, and currently, our services are only available to US-based individuals. However, some data may be transferred to international regions due to partnerships with service providers located outside the US. If you are not based in the US, we advise against using our services as they are not intended for non-US residents at this time.

7. YOUR PRIVACY RIGHTS AND PREFERENCES

At Practical Trainer, we prioritize our Members' privacy and respect your right to control your personal data. We provide tools to help you manage the personal data we collect, ensuring it remains accurate and reflects your preferences.

Please note that we may retain some of your personal data as permitted by law, even if you request deletion. We retain personal information when necessary to:

  • Complete transactions for which the information was collected, fulfill warranty or recall obligations, provide services you’ve requested, or perform a contract between you and Practical Trainer;

  • Detect and protect against security threats, fraud, or illegal activity, or prosecute those responsible;

  • Debug and repair functionality issues;

  • Comply with legal obligations, warrants, or litigation holds.

If you choose to delete your account, all associated information, including workouts and achievements, will be deleted. The deletion process may take time for technical reasons. We will confirm your identity before processing any requests, and we may not fulfill requests if we cannot verify your identity or authority to act on someone’s behalf.

7.1 Consent

If we have collected your personal information with your consent (including sensitive data), you can email us at support@getpracticaltrainer.com to remove or update specific information.

7.2 Direct Marketing

We may use your data for direct or indirect marketing purposes. If you do not wish for your data to be used for marketing, contact us at support@getpracticaltrainer.com.

7.3 "Do Not Track" / Global Privacy Control

We do not support "Do Not Track" (DNT) signals from browsers, as there is no industry-wide standard for this technology.

8. DATA RETENTION

Practical Trainer retains the personal information we collect for as long as you use our Services or as necessary to fulfill the purposes outlined in this Privacy Policy. This includes providing our Services, resolving disputes, establishing legal defenses, conducting audits, pursuing legitimate business interests, enforcing agreements, and complying with applicable laws. CCTV images are retained for 30 days. When we no longer need to retain personal information for these purposes, we will destroy, erase, or de-identify it.

In some cases, legal requirements may obligate us to retain certain personal information for a longer period than we would otherwise.

We take measures to ensure your information is handled securely and in line with this Privacy Policy. We implement commercially reasonable administrative, technical, and physical safeguards, which vary based on the sensitivity of the personal information, to protect against unauthorized use, disclosure, or access to your data.

Practical Trainer Services are not intended for or directed toward children. If we discover that we have collected personal data from a child under the minimum age, we will promptly delete that information.
